DMCA Notice & Takedown Policy

Rua Music by Klesia ("Service") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we have established the following policy for reporting and addressing copyright infringement. All our music is completely original so we would be surprised if we ever get a DMCA infringement.

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been infringed upon through our Service, you may submit a DMCA notice to our designated Copyright Agent. The notice must include the following information:

  1. Identification of the Copyrighted Work: Provide a detailed description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are involved, you may provide a representative list.

  2. Identification of the Infringing Material: Identify the specific content that you claim is infringing and include the URL(s) or other information sufficient to locate the material on our Service.

  3. Your Contact Information: Provide your name, address, telephone number, and email address.

  4. Statement of Good Faith Belief: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.

  5. Statement of Accuracy and Authority: Include a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.

  6. Electronic or Physical Signature: Include your physical or electronic signature.

Please note that incomplete or improperly formatted notices may not be processed. Upon receipt of a valid notice, we will take reasonable steps to remove or disable access to the infringing material and notify the user who uploaded the material.

2. Submitting a DMCA Notice

You can submit your DMCA notice to our designated Copyright Agent using the following contact information:

3. Counter-Notice Procedure

If you believe that the content you posted was removed or disabled in error, you may submit a counter-notice. The counter-notice must include the following:

  1. Identification of the Material: Identify the material that was removed or disabled and the location where it appeared before it was removed.

  2. Your Contact Information: Provide your name, address, telephone number, and email address.

  3. Statement of Good Faith Belief: Include a statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  4. Consent to Jurisdiction: Include a statement that you consent to the jurisdiction of the federal court in the district where your address is located or, if your address is outside the United States, in the jurisdiction where Rua Music by Klesia is located, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.

  5. Electronic or Physical Signature: Include your physical or electronic signature.

Upon receipt of a valid counter-notice, we will forward it to the party who submitted the original DMCA notice. If the original complainant does not file a lawsuit within 10 business days, we will restore the removed content.

4. Repeat Infringer Policy

We reserve the right to terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been the subject of multiple DMCA notices.

5. Misrepresentations

Please be aware that under the DMCA, anyone who knowingly misrepresents that material or activity is infringing may be liable for damages, including costs and attorney's fees.
